Whereas:

  • We provide this Privacy Notice to achieve our responsibilities under the General Applicable and Implementation Directive (GAID) which requires greater accountability and transparency from organizations regarding your personal information, and which gives you greater control over how we use it.
  • This Privacy Notice, therefore, clarifies how and when we collect personal data from and about you, why we do so, and how we treat this information and serves as a guide as to how personal data is managed by Guinness Nigeria. It also elucidates your rights concerning the collection of personal information and how you can exercise those rights.


Who does this notice apply to?

  • any person(s) who visits our websites, social media platforms, events and premises;
  • any person(s) who contracts with us for the provision of products and services, or who purchases a product from us (“customers”), including potential customers to the extent Guinness Nigeria processes your personal data;
  • resellers such a Guinness Nigeria distributor and agents as well as partners (“resellers”) including potential resellers to the extent Guinness Nigeria processes your personal data; and
  • any other persons (save for employees and job applicants) who share personal data with Guinness Nigeria including beneficiaries, Guinness Nigeria guests, etc (“other Data Subjects”).

  • Restrict Processing: If you are uncertain about the accuracy or our use of your information, you can ask us to stop using your information until your query is resolved. We will inform you of the outcome before we take any further action in relation to this information.
  • Erasure: You can ask us to delete your personal data if deleting your data is not in conflict with our legal and regulatory obligations. If we are using consent to process your information and you withdraw it, you can ask us to erase your information.
  • Automated Processing: you have the right, under certain circumstances, not to be subjected to a decision based solely on automated processing of your personal data.

Does Guinness Nigeria Process my Personal Data Automatically?

Guinness Nigeria will not perform any decision making, based solely on the automated processing (including profiling) of your personal data which results in legal consequences for you and/or which affects you in a similarly significant manner. We may use automated decision making if the decision is taken in connection with the conclusion or execution of a contract and

    the request of the Data Subject in terms of the contract has been met and
  • ‘appropriate measures’ have been taken to protect the Data Subject’s legitimate interests (i.e. providing an opportunity for the Data Subject to make representations about the decision and providing the Data Subject with sufficient information about the underlying logic of the automated processing.


Dispute Resolution and Complaint Handling Mechanism

In line with our objective of creating a rewarding customer experience on our website, Guinness Nigeria has developed a dispute resolution and complaint handling process to ensure the effective management and timely resolution of all complaints relating to this Privacy Notice. We will investigate and work towards ensuring the prompt resolution of all disputes and complaints relating to the use and disclosure of personal data in line with the provisions of the GAID.

In the event that the outcome of the resolution of your complaint is unsatisfactory, you are at liberty to lodge a complaint to the Nigeria Data Protection Commission (NDPC).

Transfer of Personal Data

Guinness Nigeria shall implement appropriate safeguards to ensure the security of personal data to be transferred to a foreign country in compliance with the provision of the Nigeria Data Protection Act 2023 (“NDPA”) and the General Application Implementation Directive (“GAID”) or any other applicable data protection legislation. In particular, we shall, among other things, enter into Data Processing Agreements with the recipients of such personal data in the foreign country to ensure protection of your personal data.

Where personal data is to be transferred to a recipient in a foreign country deemed to have inadequate data protection laws, Guinness Nigeria will take all necessary steps to ensure that informed consent is obtained from you, and you are aware of the risks inherent including ensuring that personal data is transmitted in a safe and secure manner.

Data Security and Retention

We take the security of your personal data in our possession seriously. In line with our commitment to protect your personal data in our possession, we have developed appropriate organizational, technical and physical measures to protect the personal data you provide, or we collect against unauthorized access, loss or theft, as well as against any risk of loss, disclosure, copying, misuse or modification. Such measures include but are not limited to the use of secure servers, firewall, multiple factor authentication security, data anonymization and pseudonymization (as may be necessary), data encryption and granting access on a need-to-know basis only to employees in order to perform their job responsibilities.

Guinness Nigeria will only retain your personal data under the following circumstances:

  • as long as reasonably necessary for the purpose of providing our services to you; and
  • for the period needed to comply with our legal and statutory obligations under applicable law.

This privacy notice is designed to help you understand how we use and protect the information obtained about you when you register to gain access into Guinness Nigeria premises, or any of our facilities, and during or after your visit with us.

We collect information from you when you visit our premises for the purpose of Identification and determining whether to grant you access into the premises. It is important that you read this notice, so that you are aware of how and why we are using such information.

In accordance with data protection legislation, we are legally responsible for the personal data we collect and hold about you. However, this notice does not form part of a contract to provide services and we may update this notice periodically.

How we use your personal information and the legal basis of processing

We process your personal data for the following purposes:

  • Ensuring the security and safety on our premises.
  • Managing access of visitors to our premises.
  • Issuing visitor and access badges.
  • Making meeting room bookings or managing restaurant booking or catering services.
